Clubroom Use Agreement

This Clubhouse Use Agreement (hereinafter, Agreement) is entered by and between The Stonebridge Homeowners Association, Inc., incorporated in accordance with the General Laws of the State of Maryland, (hereinafter, SHA) and the property Owner* of record listed below (hereinafter, Me, You, or I) as of the date last entered below.

I hereby certify that I am the Property Owner, in good standing, of the home within the Stonebridge Community

Whereas, SHA maintains a Clubhouse in one of the common areas of the Stonebridge Community and I now request a limited and revocable license to use the Clubhouse subject to the terms and conditions of this Agreement for the following event as detailed above.

This Agreement permits you to use the Clubhouse only for this one event on the following date and between the hours as detailed above.

MAINTENANCE/RENTAL FEE: The ClubRoom rental fee is $200 for Stonebridge Home Owners in good standing. This includes the set-up and tear down of tables & chairs + cleaning of the ClubRoom and restrooms per event. By submitting and signing this agreement you agree to pay this charge in advance. You may pay via Credit Card or Check

SECURITY DEPOSIT: $500.00 as security for the performance of your obligations under this contract. The security deposit will be charged to the credit card on file (see Maintenance/Rental Fee above) if deemed appropriate at the sole discretion of the management company representative/agent or it shall be in the form of a separate check which shall be returned or destroyed after the event.

SHA reserves the right to hold other (non-conflicting) events within the Clubhouse.

AGREEMENT
In consideration of the mutual covenants to be performed by each of the parties hereto, and set forth herein, the SHA and I hereto agree as follows:
The SHA and I hereby agree that:
I, the Owner will be present at all times and supervise the use of the Clubhouse; unless I have delegated the supervision to my Renter; hereafter referred to as Member
I will have the use of the Clubhouse for My benefit and the benefit of My guests.
This Agreement is subject to the following provisions and restrictions:

  1. The Clubhouse is for use by SHA Members and their guests only and may not be used solely by non-Members.
  2. Responsibility for damage: * Any SHA property broken, damaged, or removed from the Clubhouse or grounds by the Member or the Member’s guests, or as a result of the Member’s failures to adequately secure the Clubhouse after use, shall be the responsibility of the Member and shall be paid for by the Member. The SHA reserves the right to retain all of the security/damage deposit necessary to pay for SHA property which is broken, damaged or removed from the Clubhouse or grounds. It is further agreed that the Member shall pay to the SHA, on demand, any additional sum necessary to repair or replace broken, damaged or missing property in the event the cost exceeds the amount of the damage deposit. The full damage deposit shall be forfeited by the Member when the use of the Clubhouse results in any event beyond the ordinary operations of the Clubhouse.
  3. These events include but are not limited to:
    1. Any of the SHA Board Members or Management Representative/Agent having to be called to the Clubhouse.
    2. The police having to respond to the Clubhouse, even if a false alarm burglar call (See # 4 below)
    3. The pool company employees having to remain beyond normal working hours.
    4. No open flames are permitted in the Clubhouse at any time with the exception of “sterno” type heaters for serving dishes. A fire extinguisher is available in case of an emergency.
    5. Except for limited “re-heating” of previously cooked items in the Clubhouse microwave no other cooking whatsoever is permitted.
      Your FOB will be programmed for access to the stairs, elevator and ClubRoom door one (1) hour before the event scheduled start time. Entry is only with this FOB which will control the deactivation of the Burglar alarm system. If you need access in advance of this time, complete the set-up time and tear down sections

 

If other Owners/Renters need FOB access please list their names below. Only a programmed FOB will open the doors
The Clubhouse shall be closed and vacated no later than one (1) hour after the END TIME indicated below. The burglar system will be automatically activated at this time

The swimming pool, locker rooms and pool deck may not be used and are specifically excluded from this rental Agreement

The rear 2nd floor deck/balcony is for emergency egress only – this is not to be used as a standing area/balcony
If you intend use the elevator to move extensive event supplies to the ClubRoom you agree to have previously notified the SHA to coordinate the placement of protective covers on the elevator walls. There will be an additional $60 surcharge for the labor needed to install and remove these protective covers. Notwithstanding the fee or use of protective covers such use does not release you from responsibility for any damage whatsoever to the elevator occurring during the event.

All personal property, including but not limited to vehicles parked in the Clubhouse parking lot, placed at the Clubhouse or elsewhere upon the SHA property, shall be placed at your own risk, or at the risk of the person owning such property, and you agree to identify, defend, and hold harmless SHA, its directors, officers, employees and agents for any loss, claim, injury or damage which occurs to such property during or that arises from your use of the Clubhouse.

The consumption of alcoholic beverages is permitted ONLY INSIDE the Clubhouse area. It is your responsibility to obtain any required licenses or permits that may be necessary for the distribution or consumption of alcoholic beverages. You acknowledge and agree that any such permits have been or will be secured if required and to be solely responsible for any fines or penalties for your failure to obtain such licenses or permits. You agree to comply with all applicable laws and regulations concerning the consumption of alcoholic beverages on the premises and agree to defend and indemnify the SHA its directors, officers, employees and agents and hold them harmless on the account of any violation of such laws and regulations.
No outdoor amplification of music is permitted. Music is permitted inside the ClubRoom, but must be kept to a reasonable level

FAILURE TO COMPLY WITH ANY OF THE PROVISIONS OF THE FOLLOWING PARAGRAPH (13a – e) WILL RESULT IN THE FORFEITURE OF THE SECURITY/DAMAGE DEPOSIT.
– a. You are responsible for tidying, removing all trash, food, serving utensils, decorations and returning furniture to its original location.
– b. Do not use any pins, tacks, staples, nails to secure decorations – use only removable non-stick tape
– c. All lights must be turned off before vacating the ClubRoom, with the exception of “Exit” signs and emergency security lights which will remain illuminated at all times.
– d. The kitchen must be left clean, including the refrigerator and all faucets and toilets are to be checked to be sure no water is left running.
– e. The main ClubRoom door will automatically lock one (1) hour after the end of your event. Ensure the deadbolt is activated on the balcony door.

You hereby agree to indemnify, defend, and hold the SHA its directors, officers, employees and agents harmless from and against any and all liabilities, claims, demands, costs, and expenses or every kind and nature, including those arising from any injury or damage (including death) to any person or property sustained or arising out of Your use of the Clubhouse or from Your failure to follow the rental and use rules. You further release and waive all claims against the SHA its directors, officers, employees and agents for injury or damage to you or your invitees in or about the Clubhouse as a result of or in any way arising from your use and occupancy of the Clubhouse or in any other manner which relates to your use of the Clubhouse.

In addition to and in consideration of the sum of One Hundred Dollars ($100.00) acknowledged to have been paid and for other good and valuable consideration, the receipt and sufficiency is acknowledged, you agree that to the extent permitted by Maryland law in the event of Your default of this Agreement, the SHA shall have a lien upon the real property listed above for breach of any of the terms of this agreement and the SHA shall have the right to file such lien against the property stated above. You hereby irrevocably appoints the SHA as your attorney in fact to execute any document necessary to enforce this section or any of the other terms of this agreement.

You agree to comply with all local and state laws, orders, or governmental regulations and/or ordinances. You also agree to abide by the rules and regulations of the SHA for the use of the Clubhouse, which are adopted from time to time, and the stipulations of this Agreement. SHA has the right to modify the rules and regulations from time to time and shall have no liability to You for its enforcement or waiver of such rules and regulations. You agree and certify that you have received and reviewed a copy of the rules and regulations regarding the use of the Clubhouse. The rules are hereby incorporated in this rental agreement and the documents. In case of a conflict between this Agreement and the Rules and Regulations, this Agreement shall control.

You agree that any 3rd party vendors for any party supplies, food, entertainment, or any other services shall maintain Workers Compensation and General Liability Insurance as required by Maryland State law. You will be held personally responsible if these Insurances are not deemed sufficient in the event of a loss. * A resident member of Stonebridge who is renting their home from an Owner, must have the OWNER advance permission to enter into this ClubRoom Agreement. Abaris will contact the Owner to sign the agreement, which must be received BEFORE the event date.
